Entitlement According to Protection Status
1. Status: Before applying for protection
Health Entitlement: Emergency healthcare and essential treatment of illness, including that of serious psychological conditions.
2. Status: Asylum seeker / applicant for international protection
Health Entitlement: The necessary emergency healthcare and essential treatment of illness and serious mental disorders. Medical assistance or other assistance required for applicants with special reception needs, including appropriate mental healthcare where necessary.
3. Status: Refugee Status (1951 Geneva Convention, and Regulation (EU) 2024/1347)
Health Entitlement: State medical care.
Family members of a person granted refugee status, if they are in Malta at the time of the decision or if they join that person in Malta, enjoy the same rights and benefits as refugees so that family unity can be maintained.
4. Status: Subsidiary Protection Status (Regulation (EU) 2024/1347)
Health Entitlement: State medical care.
Family members of a person granted subsidiary protection, if they are in Malta at the time of the decision, enjoy the same rights and benefits as the person who enjoys subsidiary protection status so that family unity can be maintained.
5. Status: Temporary Humanitarian Protection Status (Art. 17A of the International Protection Act)
Health Entitlement: State medical care.
6. Status: Rejected asylum application
Health Entitlement: Life-saving medical assistance.
7. Status: Person appealing the decision of the International Protection Agency
(Asylum seeker / applicant for international protection)
NB – The legal status of the appellant reverts to that of a person applying for asylum / international protection.
Health Entitlement: The necessary emergency healthcare and essential treatment of illness and serious mental disorders. Medical assistance or other assistance required for applicants with special reception needs, including appropriate mental healthcare where necessary.
8. Status: Specific Residence Authorisation (SRA)
Health Entitlement: State medical care (Specific Residence Authorisation Regulations of 2020).
9. Status: Victims of Human Trafficking (third countries)
Important: Applies only to persons recognised as victims of human trafficking under LS 217.07
1. During the Reflection Period
Health Entitlement: Emergency medical care, attention to the needs of the most vulnerable, and psychological help (LS 217.07 Art. 3 (5) (ii, iii and iv)).
2. After the Residence Permit is issued
Health Entitlement: Emergency medical care (continued), psychological help (continued) and necessary medical care or other assistance, when the person does not have sufficient resources and has special needs, such as in the case of pregnant women, persons with disabilities, victims of sexual violence or some other form of violence, and minors (LS 217.07 Art. 5 (3)).
10. Status: Persons coming from Ukraine – Temporary Protection Status (Directive 2001/55/EC)
Health Entitlement: Medical care (including, at least, emergency healthcare of an essential nature and essential treatment of illness)
